Acceptance of Terms and Conditions
By paying your deposit and making a payment on your order, you are agreeing to all the terms and conditions. Terms and conditions are subject to change without notice.

Order Confirmation and Payment
To confirm your order, we require 50% of your final balance as a non-refundable deposit. The non-refundable deposit must be made within 3 days of date of invoice. Your order is not confirmed until the non-refundable deposit has been received.
Final payment/remaining balance is due 5 days prior to scheduled pickup/delivery date. You are also welcome to pay in full at the time of booking.
If your event is less than 3 weeks away, we will need to receive full payment at the time of booking.
*Please note that your order is not confirmed until the non-refundable deposit has been received, so if another client is looking to book on the same day, we will book whoever completes their non-refundable deposit first.
Our preferred payment methods are Zelle and CashApp. An order will not be handed out without full payment.

Design
We will not copy or replicate another artists work. We will take inspiration from any images sent and come up with our own design.

Design Changes
You may request changes to your order up until two weeks prior the scheduled pickup/delivery date. In doing so, you understand that any changes to the size, design, flavors and additional customizations will incur an additional cost and will affect the final cost of the cake. Depending on the changes, we may require additional payment, even if the non-refundable deposit has already been made.
Please note we will not accept any changes to your order that are requested less than two weeks prior to your event.

Cancellations
Deposits and/or upfront payments are non-refundable. Cancellations made at least 72 hours prior to the scheduled pickup/delivery date will receive a refund at the discretion of Sweets by Cheeks. This is based on any preparation for your order and if profits were lost on other potential cake orders that were declined. Cancellations made less than 72 hours before the scheduled pickup/delivery date will not be refunded.
If you need to change the date of your order, please contact us as soon as possible. Please note date changes are subject to availability.

Refunds
We want you to be 100% satisfied and happy with your order. However, refunds requested due to dissatisfaction of design, color shade or general decoration will not be given. If you are unsatisfied with the flavor quality of your cake and request a refund, this will be assessed at our discretion.

Damage
We will aim to provide as much detail and assistance as it relates to the best storage for your order. We are not liable and/or responsible for any damage that may occur after the cake has been picked up and transported by you and/or your designated pick up person or after we have delivered and handed off the cake to you and/or your designated person accepting the delivery to your address or event location. Cake and desserts should not be displayed in direct heat and/or sunlight. Any damage done to the cake due to climate conditions will not be subject to a refund or discount. Pickup and Delivery
Deliveries for single tier cakes, cookies, brownies, etc. (non-wedding related/2+ tier cake orders) are a flat fee of $10 within a 30-mile radius of 75072. For deliveries outside of the 30-mile radius, a flat fee of $20. Deliveries exceeding 50 miles are subject to an additional charge.
Any last minute changes to the delivery date/time/location will result in an additional fee and is subject to availability.
You are more than welcome to pick up your order. We cannot guarantee freshness of the product if you do not provide adequate notice of change in pickup time.
Once again, please note we are not liable for any damages to the cakes that are picked up and transported by you and/or your designated pick up person or after we have delivered and handed off the cake to you and/or your designated person accepting the delivery to your address or event location.

Allergens
While we do follow good handling and food safety practices, we cannot guarantee products that are completely free of allergens. Please be advised our kitchen does contain and produce items with eggs, nuts, soy, peanuts, milk, wheat, and other possible cross contaminants. Sweets by Cheeks cannot be held responsible for any medical issues that arise from consumption of product.
